Direito à Proteção Familiar

Os direitos de proteção da família, consagrados em sentido formal, na Constituição da República Portuguesa, são uma realidade com mais de 80 anos. Solidamente afirmados nos dias de hoje, não deixam de levantar interrogações quanto à possibilidade de o Estado se estar a intrometer em domínios da esfera privada. Como se cumprem tais desígnios e como se conseguem os equilíbrios entre direitos fundamentais, por vezes antagónicos, foi o nosso propósito. Por isso, quisemos ao longo do presente artigo analisar a fundamentalidade da proteção familiar em sentido formal e em sentido material, bem como tem sido este percurso ao longo dos diversos textos constitucionais, desde 1822, que vigoraram em Portugal. The family protection rights, which are formally consecrated in the Constitution of Portuguese Republic, have been a reality for over 80 years. In spite of being recognized by everyone, they still raise questions on whether the state should or not interfere with private affairs. Our purpose was to study how such ideas have been fulfilled as well as the balance between these fundamental rights have been achieved. Therefore, throughout the article, we analysed the fundamentality of the protection of the family in both its formal and material senses. We have also looked into various constitutional texts that have been used in Portugal as far back as 1822.
